3. PERSONAL DATA PROTECTION. ADDITIONAL INFORMATION.
Data processing:
The data collected through the data collection forms of the Portal shall be processed by Vermont Academy in a lawful, loyal, and transparent manner in relation to the data subject.
 
The data collected by Vermont Academy shall be used for the following purposes:
 
For the performance of work typically related to a teaching center.
  • We process your personal data in the exercise of the teaching role in the social, academic, guidance, and sports fields).
For the development and maintenance of the legal relationship contracted in the hiring of school services and extracurricular activities.
For the management, control, and processing of payment of grants and scholarships.
For the promotion and development of activities organized or promoted directly or indirectly by Vermont Academy.
For the maintenance of the relationship with our suppliers.
  • We process the data of our suppliers whether they are natural or legal persons, for example, in the relationship with supply providers.
For the fulfillment of an employment or contractual relationship.
  • We process the personal data of our employees and partners to comply with the employment, contractual, or pre-contractual relations maintained with Vermont Academy.
For recruitment processes.
  • We process the personal data of all job candidates to manage their participation in the recruitment processes carried out by Vermont Academy.
Solely data that are adequate, relevant, and limited to what is necessary in relation to the purposes for which they are processed shall be processed. The data shall be kept only for the time necessary for the purposes of processing.
 
Entitlement.
  • The entitlement for processing is based on the execution of a contract for the provision of services or the fulfillment of a legal obligation, for the improvement of the quality of education.
 
Sending curricula.
  • Curricula vitae and job applications received through the forms, email addresses or links on this web page shall be processed by Vermont Academy in accordance with the provisions of the preceding section and may be used in Vermont Academy's recruitment processes.
 
Data communication.
As stated in the basic information no data shall be transferred to other third parties except where subject to legal obligation. In those cases, in which it is necessary, data of the data subjects may be transferred as explained, to those organizations entitled to obtain them: Education Authorities, Tax Authorities, Courts, or any other by law or administrative order.
 
Rights of the Data Subjects.
  • The User is entitled to obtain confirmation as to whether Vermont Academy is processing personal data concerning them.
  • Users are entitled to access their personal data, as well as to request the rectification of inaccurate data or, where appropriate, request deletion when, among other reasons, the data are no longer necessary for the purposes for which they were collected.
  • In certain circumstances, users may request the limitation of the processing of their data, in which case we shall keep them solely for the exercise or defense of claims.
  • In certain circumstances and for reasons related to their particular situation, the data subjects may object to the processing of their data. In this case, Vermont Academy shall stop processing the data, except for compelling lawful reasons, or the exercise or defense of possible claims.
 
To exercise their rights the data holder must send an email to IT@vermontacademy.org, specifying such request, which must contain the following data: name and surname of the user, address for notice, copy of the National Identity Card or Passport, and petition in which the request is specified. In the case of representation, this must be proven by reliable documentary evidence.
 
Adoption of security measures.
  • The processing of data guarantees the adequate security thereof, including protection against unauthorized or unlawful processing and against their loss, destruction, or accidental damage, through the application of appropriate technical or organizational measures.
 
Personal data of minors.
  • Vermont Academy considers that children deserve specific protection of their personal data, as they may be less aware of the risks, consequences, guarantees, and rights concerning the processing of personal data. That specific protection should apply to the use of personal data of children for marketing or personality or user profiling purposes, and to the collection of personal data relating to children when services offered directly to a child are used. Vermont Academy complies with the Convention of 20 November 1989 on the Rights of the Child, adopted by the General Assembly of the United Nations, and Organic Law 1/1996 of 15 January on the Legal Protection of Minors, approved by the Spanish Parliament, as well as similar legislation enacted in other countries to protect minors.
 
4. TERMS OF USE OF THE PORTAL.
General Terms
  • The User undertakes to make proper use of the Portal in accordance with the Law and this Legal Notice. The User shall be liable to Vermont Academy or third parties for any damages that may be caused as a result of a breach of this obligation.
 
Contents
  • The User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as with the other conditions, regulations, and instructions that may apply.
  • By way of example, the User in accordance with current legislation must refrain from the following:
  • Reproduce, copy, distribute, make available, publicly communicate, transform, or modify the Contents except in cases authorized by law or expressly consented to by Vermont Academy or by the holder of the ownership of the exploitation rights where appropriate.
  • Reproduce or copy for private use the Contents that may be considered as Software or Database in accordance with current legislation on intellectual property, as well as their public communication or making available to third parties when these acts necessarily imply reproduction by the User or a third party.
  • Extract or reuse all or a substantial part of the Contents of the Portal, as well as the databases that Vermont Academy makes available to Users.
  • Use the contents and in particular, the information obtained through the website to send advertising, send messages for commercial purposes, or collect or store.
 
Data collection forms
  • All the information provided by the User through the Portal forms for the above purposes or any other must be truthful. For these purposes, the User guarantees the authenticity of all data communicated and shall keep the information provided to Vermont Academy perfectly updated so that it responds, always, to the User's real situation. In any case, the User shall be solely responsible for false or inaccurate statements made and the damages caused to Vermont Academy or third parties due to the information provided.

  • The Internet user who wishes to insert links from their own web pages to the Portal must comply with the conditions detailed below without unawareness thereof exonerating them from liability derived from the Law:

No false, inaccurate, or incorrect statement about Vermont Academy, its partners, employees, customers, or the quality of the services it provides shall be made from the web page inserting the link.
 
In no case shall it be expressed on the web page where the link is located that Vermont Academy has given its consent for the insertion of the link or that it otherwise sponsors, collaborates, verifies, or supervises the services of the sender.

  • Access to the Portal does not imply the obligation on the part of Vermont Academy to verify the veracity, accuracy, adequacy, suitability, completeness, and timeliness of the information provided through it.
Vermont Academy is not liable for the decisions made based on the information provided on the Portal or for the damages caused to the User or third parties due to actions that are based solely on the information obtained on the Portal.
 
Availability of the Service
  • Access to the Portal requires services and supplies from third parties, including transport through telecommunications networks for whose reliability, quality, continuity, and operation Vermont Academy is not liable. Accordingly, the services provided through the Portal may be suspended, canceled, or become inaccessible, prior to or simultaneously with the provision of the Portal service.
 
Contents and services linked through the Portal.
  • The Portal access service includes technical linking devices, directories, and even search tools that allow the User to access other Internet pages and portals (hereinafter, 'Linked Sites'). In these cases, the Vermont Academy acts as a provider of intermediation services in accordance with article 17 of Act 34/2002, of July 12, Services of the Information Society and Electronic Commerce (LSSI), and shall only be liable for the content and services provided on the Linked Sites to the extent that it is effectively aware of the illegality and has failed to disable the link with due diligence. In the event that the User considers that there is a Linked Site with illicit or inappropriate content, he/she may report this to Vermont Academy, without such communication in any case implying the obligation to remove the relevant link.
 
In no event shall the existence of Linked Sites imply the existence of agreements with those responsible or owners thereof, nor the recommendation, promotion, or identification of Vermont Academy with the statements, contents, or services provided.
Vermont Academy is not aware of the contents and services of the Linked Sites and therefore is not liable for the damages caused by the illegality, quality, outdatedness, unavailability, error, and uselessness of the contents or services of the Linked Sites or for any other damage that is not directly attributable to Vermont Academy.
 
6. INTELLECTUAL AND INDUSTRIAL PROPERTY.
All contents of the Portal, which is understood to include but not be limited to, text, photographs, graphics, images, icons, technology, software, links, and other audio-visual or sound content, as well as its graphic design and source codes (hereinafter, the "Contents"), are the intellectual property of Vermont Academy or third parties, while none of the exploitation rights recognized by current intellectual property legislation thereon shall be deemed assigned to the User, except those that are strictly necessary for the use of the Portal.
The trademarks, trade names, or distinguishing marks are owned by Vermont Academy or third parties, without it being understood that access to the Portal confers any right over the trademarks, trade names or distinguishing marks.
